This Agreement is between you, the user of the mozdev Web Site ("You"), and Mozdev Community Organization, Incorporated, a New York Not-for-Profit corporation ("mozdev"). This Agreement sets forth the terms and conditions governing Your use of mozdev's Web Site currently located at www.mozdev.org (the "Site"), Your hosting of any project on the Site and Your use of mozdev's systems and services, and is in addition to any executed agreements You may have with mozdev. BY PRESSING THE "I ACCEPT" BUTTON OR ACCESSING THE SITE, YOU ACCEPT, WITHOUT LIMITATION OR QUALIFICATION, ALL OF THE TERMS AND CONDITIONS IN THIS AGREEMENT. If You do not accept all of the terms and conditions of this Agreement, do not use the Site. mozdev may amend this Agreement at any time by posting the amended terms on the Site and such terms shall be effective for all use of the Site and services once they are posted. mozdev, in its sole discretion, may also add, delete or change some or all of the features of the Site or mozdev's services at any time.
1. Purpose of the Site; Standards of Use.
The Site has been created as a resource for the Mozilla community with the purpose of providing free project hosting and development tools.
mozdev provides access to a variety of online project hosting and development tools, including, without limitation, templates, project configuration, online forums, various communications tools, source code control (together, the "Services").
mozdev reserves the right, in its sole discretion, (a) to edit, block or remove any Content that it considers to violate this Agreement or to be otherwise illegal or harmful; (b) to remove or refuse any project that (i) hosts Content that it deems inappropriate, (ii) uses the Services in an inappropriate or insecure manner, or (iii) is unrelated to Mozilla; and (c) to report any illegal or offending activities to the appropriate authorities.
You may not use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any transaction conducted on the Site. You may not take any action which imposes an unreasonable or disproportionately large load on mozdev's infrastructure. You may not disclose or share Your password with any third parties or use Your password for any unauthorized purpose.
You shall comply with all applicable laws, statutes, ordinances and regulations regarding Your use of the Site and the Services.
2. Conduct as a User.
You agree that You will not use the Site, the Content on the Site or the Services in an inappropriate or insecure manner or for any purpose that is unrelated to Mozilla or that is otherwise prohibited by this Agreement. You may not use any email addresses or other contact information obtained through the Site or the Service (whether relating to other mozdev users or otherwise) to send unsolicited email messages (i.e. spam) or any other unsolicited communications.
You will represent Yourself accurately and truthfully at all times. Failure to provide a valid email address or full name may be grounds for having a project request turned down. You grant mozdev the right to independently verify any information that You post on our Site about Yourself, although mozdev does not routinely undertake any verification.
You are responsible for maintaining the confidentiality of Your password and user account information. You must notify mozdev as soon as possible in the event of any known or suspected unauthorized use of Your user account, or suspected breach of security, including, without limitation, loss, theft, or unauthorized use of Your or anyone else's password. You are responsible for any and all activities which occur under Your user account.
mozdev reserves the right to constitute different classes of users of the Site, granting access to certain areas of the Site only to certain users, e.g. visitors, project participants and project owners may have access to different areas of the Site.
3. User Age Eligibility.
mozdev's services and the Site are available only to individuals who are thirteen (13) years of age or older.
4. Copyright Policies.

If You believe that Your copyright work or material has been used on the Site in a manner that constitutes copyright infringement, please provide mozdev's Copyright Agent with a written notice (email will suffice) that includes the following information:
- an electronic or physical signature of the owner or a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;
- identification of the copyrighted work claimed to have been infringed;
- a description of where the material that You claim is infringing is located on the Site;
- Your address, telephone number, and e-mail address;
- a statement by You that You have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
- a statement by You, under penalty of perjury, that the information in Your notice is accurate and that You are the copyright owner or authorized to act on the copyright owner's behalf.

5. System Integrity.
The Site contains robot exclusion headers and You agree that You will not use any robot, spider, other automatic device, or manual process to monitor, deep link with or copy mozdev's web pages or the content contained therein without mozdev's prior written consent.
6. No Warranty.
MOZDEV PROVIDES THE SITE AND ITS SERVICES "AS IS" AND "AS REASONABLY AVAILABLE" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS OR IMPLIED. TO THE FULL EXTENT PERMISSIBLE UNDER APPLICABLE LAW, MOZDEV SPECIFICALLY DISCLAIMS THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON INFRINGEMENT. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. mozdev provides no warranty or guarantee that the Site or any function contained in the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site or the servers that make the Site available are free of viruses or other harmful components. For example, operation of the Site may be subject to interference from factors outside mozdev's control and scheduled and preventative maintenance and any required or emergency maintenance work may temporarily interrupt Services or access to the Site. mozdev does not warrant or make any representations regarding the correctness, quality, accuracy, timeliness or completeness of any Content on the Site or the results of Your use of the Site or the Services. While mozdev uses reasonable efforts to back up site data and make such data available in the event of loss or deletion, to the fullest extent permissible under applicable law, mozdev has no responsibility or liability for the deletion or failure to store any messages or other communications or other Content maintained or transmitted by any Service.
7. Links on the Site.
mozdev does not review or monitor any web sites linked to the Site and is not responsible for the Content of any such linked web sites. mozdev provides these links solely as a convenience and does not endorse any third party site or any content, products or services available on a third party site. Your linking to such web sites is at Your own risk.
8. Limitation of Liability.
IN NO EVENT SHALL MOZDEV BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, YOUR USE OF THE SITE OR THE SERVICES. SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSIONS SHALL ONLY APPLY TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAW. THIS SECTION 8 DOES NOT LIMIT LIABILITY FOR BODILY INJURY OF A PERSON.
TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, MOZDEV'S AGGREGATE LIABILITY TO YOU IN ANY CIRCUMSTANCE IS LIMITED TO $100.
mozdev reserves the right to terminate Your access to the Site for any reason, on written notice to You, which may be given via email or otherwise.
10. Integration and Severability.
11. Applicable Law.
The Site is controlled by mozdev from its offices within the State of New York, USA. The laws applicable to the interpretation of this Agreement shall be the laws of the State of New York, USA, and applicable federal law, without regard to any conflict of law provisions. Those who choose to access the Site from outside the United States do so on their own initiative and are responsible for compliance with local laws. You agree to submission of any dispute to the state and federal courts of the State and County of New York, USA.
12. Release and Transfer.
If You have a dispute with one or more other users of the Site, You release mozdev (including its officers, agents, affiliates, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind arising out of or in any way connected to these disputes. If You are a California resident, You waive California Civil Code section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor." mozdev may at any time assign, sub-license, subcontract, transfer or otherwise dispose of any of its rights or obligations under this Agreement.

14. Project Adoption Policy.

15. Fixing web errors.
Mozdev reserves the right to update inactive projects' hosted web content when the projects are generating warnings or errors that are easily fixed without affecting current website functionality. Mozdev will contact the project contributors to have the problems corrected, but in extreme circumstances the changes may be enacted prior to contact.
